Who We Are
Spark Road Media ("Spark Road Media," "we," "us," or "our") designs, builds, hosts, and maintains websites for local service businesses, and operates the Hometown Card shared direct-mail program. Spark Road Media is a division of EMH Stores LLC. This Privacy Policy explains what we collect when you visit sparkroadmedia.com, submit a form, chat with our website assistant, purchase a service, or receive marketing from us; how we use that information; who we share it with; and the rights you have. We will note any changes by updating the "last updated" date above.
Information We Collect
Information you give us directly: your name, business name, email address, phone number, website address, and anything you include in a contact form, an order form, a chat message, or a booked call. Technical and derivative information collected automatically: IP address, browser and device type, referring page, the pages you view, and the dates and times you access the site. Some of this is collected through cookies and similar technologies (see "Cookies and Tracking"). Conversation data: messages you exchange with our website chat assistant. Payment information: when you purchase, payment is handled by our third-party processor. We do not store full card numbers. We receive confirmation that a payment succeeded, along with the amount and a transaction reference. Website scan data: if you request a site health report, we collect the website address you submit and the technical results of the automated scan we run against that public page.
Information We Collect From Other Sources
We also obtain business contact information about companies and the people who run them from sources other than you directly, so that we can identify and contact potential clients. These sources may include: • Publicly available websites, business directories, and map and review listings • Business data providers, list providers, and lead-generation services • Email verification and phone validation services, which we use to check whether a business address or number is deliverable and reachable • Publicly visible social and professional networking profiles The information collected this way is business contact information — such as business name, owner or contact name, business email address, business phone number, business address, industry, and publicly visible details about the business's website. We use it to research whether our services are relevant to your business and to contact you about them. We do not use it to build profiles of your personal life, and we do not sell it. If we contact you this way and you would rather we did not, tell us and we will stop. You can ask us to remove your information at any time by emailing us, and you can ask what information we hold about you and where we obtained it.
AI Technologies and How We Use Them
Our website includes an AI chat assistant, and some of the services we build for clients include AI chat or voice features. When you interact with these features: • You may be interacting with an automated system rather than a person. • Conversations may be stored and reviewed to answer your question, follow up accurately, and improve the quality of the service. • You can ask to speak with a person at any time. • You can ask us to delete a conversation, and you can ask us not to use your conversations to improve our systems, by emailing us. Our AI features are not intended to collect sensitive personal information, and you should not share it with them. If sensitive information is shared inadvertently, we will make reasonable efforts to delete it, and we take reasonable steps to keep it out of any data used to improve our systems.
How We Use Your Information
We use your information to: respond to your inquiries and chat messages; prepare quotes and proposals; design, build, host, and maintain your website; deliver the Hometown Card direct-mail program; schedule and confirm appointments; process payments and refunds; send onboarding details, account notices, and service updates; run and deliver website scan reports you request; prevent fraud and abuse; meet our legal obligations; and, where you have opted in or where permitted for business contacts, send you relevant offers.
How We Share Your Information
We do not sell your personal information, and we do not transfer it to outside parties for their own marketing purposes. We share it with service providers who help us operate, and only so they can provide their service to us: • Stripe — payment processing • GoHighLevel / LeadConnector — CRM, forms, scheduling, email, and SMS • Mailgun — delivery of email sent from our dedicated sending domain • Cloudflare — website hosting, media storage, and bot and spam protection • MindPal — the AI chat assistant on this website • Print and mail providers — production and USPS delivery of direct-mail pieces Each provider processes your data only to deliver its service to us and is expected to keep it confidential. We may also disclose information if required by law, to enforce our terms, or to protect our rights, safety, or property. Your data may be stored on servers in the United States.
Advertising and Analytics
We may use advertising and analytics platforms, including Meta (Facebook and Instagram) and Google, to understand how our site is used and to show our ads to people who have visited it. Where these are enabled, they may set cookies and receive information about your visit, which under some state laws is treated as "sharing" personal information for cross-context behavioral advertising rather than a sale. These are not essential to running the site. We only load them if you accept them in our cookie banner, and you can decline without losing any functionality. You can also opt out directly through your Meta ad preferences, your Google ad settings, or the Google Analytics opt-out browser add-on, or by emailing us.
SMS / Text Message Privacy
If you opt in to receive text messages from us: • No data sharing: all text-messaging originator opt-in data and consent information will not be shared with any third parties, excluding the aggregators and providers of the text message services necessary to deliver the SMS service. • Marketing restriction: your mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. • Limited use: your SMS opt-in data is used only for the purposes you consented to, such as appointment reminders, order and project updates, customer service replies, and any promotional messages you opted into. • Opt-out: text STOP at any time to stop messages; text HELP for assistance. Message and data rates may apply; message frequency varies.
Cookies and Tracking
We use cookies and similar technologies to operate the site, remember your preferences, and understand how the site is used. Essential cookies are required for the site to function. Non-essential cookies, including any advertising and analytics cookies described above, are only set if you accept them in our cookie banner. You can also set your browser to refuse cookies or alert you when they are used. If you disable cookies, some features may not work properly.
Direct Mail (Hometown Card)
The Hometown Card program mails shared postcards to residential delivery routes selected by USPS route, not by individual name. We do not purchase, receive, or hold a list of the names of the households that receive a card. If you are a business advertising on a card, we collect and use your business contact information, your artwork and offer details, and any tracking data generated by the QR code or phone number printed on your block, so that we can produce the card and report results to you.
Protected Health Information (HIPAA)
Our services are website, marketing, and communication services. They are not designed, configured, or offered for the handling of Protected Health Information ("PHI") as defined by the Health Insurance Portability and Accountability Act ("HIPAA"). We do not act as a Business Associate, and we do not enter into Business Associate Agreements. If you are a covered entity or a business associate under HIPAA, you agree not to submit, upload, transmit, or otherwise make PHI available to us or through any system we provide, including any website form, CRM, chat, or SMS service we build or manage for you. Do not include patient names, medical conditions, treatment details, or appointment reasons in any data submitted to us, and do not configure any service we provide to collect or store PHI from your patients. If PHI is submitted to us in error, notify us and we will delete it. You remain responsible for your own compliance obligations with respect to your patients. If your organization requires services that involve PHI, contact us before using our services; absent a separate written agreement, our services must not be used for any purpose involving PHI.
Data Retention
We keep personal information for as long as needed to provide our services and for legitimate business and legal purposes, or until you ask us to delete it. Much of this data is held inside the third-party platforms listed above, and those platforms set their own retention periods, which we do not control. Anonymized or aggregated data may be retained longer for analytics. You can request deletion of your information at any time by emailing us.
Security
We use reasonable technical and organizational measures, including encryption in transit (SSL/TLS) and access controls, to protect your information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a breach affects your personal information, we will notify you and any applicable regulators without undue delay and within the timeframes required by applicable law.
Your Rights
You can ask us to: confirm what data we hold about you; provide a copy of it; correct or update it; delete it; or change or withdraw your consent. To exercise any of these, email us at the address below. We may ask you to verify your identity before we act on a request, and we will not discriminate against you for exercising these rights.
California Privacy Rights
We honor the rights described above for California residents, in line with the California Consumer Privacy Act as amended by the California Privacy Rights Act ("CCPA/CPRA"). In addition to access and deletion, you may request that we correct inaccurate personal information we hold about you, and you may request that we limit our use of any sensitive personal information. We do not sell your personal information. If advertising platforms are enabled on this site, that activity may be treated as "sharing" for cross-context behavioral advertising under California law. You may opt out by declining non-essential cookies in our banner, by using the platform opt-out methods described above, or by emailing us.
Children's Privacy (COPPA)
Our services are intended for businesses and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us information, contact us and we will delete it.
Email Communications (CAN-SPAM)
If we send you commercial email, we will not use false or misleading subject lines or sender addresses, we will include our business contact information, and we will honor unsubscribe requests promptly. You can unsubscribe using the link at the bottom of any marketing email or by emailing us at the address below.
Third-Party Platforms
Some of what we deliver runs on third-party platforms, including GoHighLevel / LeadConnector and Cloudflare. Those platforms are owned and operated by their providers, not by us. We are not responsible for service interruptions, outages, data loss, security incidents, or feature changes originating from those platforms, and their own privacy policies and terms apply to data they process.
International Data
Our site and services are hosted on servers located in the United States. If you access our site from outside the United States, your information will be transferred to and stored in the United States, where privacy laws may differ from those in your country. By using our site and providing us with information, you consent to that transfer, processing, and storage.
Changes to This Policy
We may update this Privacy Policy from time to time. We will post the updated version here with a new "last updated" date, and changes take effect when posted. Your continued use of the site after changes are posted constitutes acceptance of the updated policy.
